These Terms & Conditions of Access (“Terms and Conditions”) govern your use of the APCO Annual Reporting Tool. Prior to using the Annual Reporting Tool, you must agree to these Terms and Conditions. Access to the Annual Reporting Tool is via a secure, encrypted password protected authentication web portal which you can access at any time. The purpose of the Annual Reporting Tool is to enable your organisation to undertake a self-assessment of packaging sustainability performance against the APCO Packaging Sustainability Framework and to meet your APC Annual Reporting requirements. Any problems or issues related to your use of the Annual Reporting Tool are to be directed in the first instance to APCO.</P
How your responses to the Annual Reporting Tool, data and evidence will be used
Your responses to the Annual Reporting Tool and any other data you provide through the Annual Reporting Tool will be used by APCO for the following purposes:
- To generate a Performance Summary Report for your organisation against the packaging sustainability framework, including a score and a set of recommendations, which your organisation can download and publish;
- To generate a Benchmarking Report for your organisation which shows the performance of your organisation against the rest of your industry sector, which your organisation can download and publish.
- To create an Annual Report and Action Plan including your planned actions to address the Performance Summary Report, which your organisation can submit directly to APCO for publication on APCO’s website; and
- APCO’s external reporting purposes, including but not limited to reporting on progress against the Covenant objectives, identifying packaging sustainability trends, and analysing data that may inform any aspect of APCO’s work towards achieving the Covenant objectives.
Intellectual Property Rights in the Annual Reporting Tool
APCO and UTS jointly own all intellectual property rights in the Annual Reporting Tool made available on this website. By agreeing to these Terms and Conditions, APCO and UTS grant you a limited non-exclusive licence to use the Annual Reporting Tool for the purposes set out above and to download data and reports via the Annual Reporting Tool, subject to the following provisions governing use of the website.
Use of this Website
Any data you download from the website is at your own risk. Subject to the licence above, all intellectual property rights belong to APCO and UTS. You may view, download for caching purposes only, and print pages from the website for your own use, subject to the restrictions set out below and elsewhere in these Terms and Conditions. You undertake to acknowledge in any written reports generated by the Annual Reporting Tool that the reports were generated by the Annual Reporting Tool licensed by APCO and UTS. You must not:
- sell, rent or sub-license material from the website;
- reproduce, duplicate, copy or otherwise exploit material on this website for a commercial purpose;
- edit or otherwise modify any material on the website; or
- redistribute material from this website except for content specifically and expressly made available for redistribution
Ownership of intellectual property (IP) in the information you provide via Annual Reporting Tool.
You remain the owner of the Intellectual Property in the data you provide via the Annual Reporting Tool. You grant APCO and relevant third parties, a royalty free, perpetual, non-exclusive licence to use, reproduce, adapt, re-configure and publish the data and any other material you submit to the site for the purposes of assisting companies on improving packaging sustainability and any other related purposes, such as to inform decisions on awards. Data included in reports published by APCO and its authorised agents and contractors will be de-identified and published in aggregate form, with the exception of the Annual Report and Action Plan document, which will contain details of your organisation and a summary of your organisation’s performance against the Annual Reporting Tool criteria.
APCO and its authorised agents and contractors are the data custodians and will access the data you provide only to the extent necessary in order to manage and provide you with the necessary feedback, reports and other related activities of APCO.
APCO and its authorised agents and contractors will at all times use the utmost skill and care in managing data and information submitted through the Annual Reporting Tool. Data submitted through the Annual Reporting Tool will be stored on the AMAZON Web Services Cloud in a secure and encrypted format, accessible only to authorised APCO personnel and personnel of its authorised agents and contractors. This system uses the latest security and encryption processes.
System Access Registers will record who has access to the data, when, the duration of such access and the purposes for which access was utilised.
The data you submit via Annual Reporting Tool can be accessed by other APCO members using the Annual Reporting Tool only in de-identified, aggregated form to enable sectoral benchmarking. You acknowledge and agree that other organisations will be able to access your organisation’s data in de-identified, aggregate form from the Annual Reporting Tool for the purpose of benchmarking.
You agree to indemnify, hold harmless and defend APCO, its personnel, authorised agents and contractors from and against any loss, damage, cost, expense or liability in relation to any unauthorised release of confidential information; claim by any person in respect of loss of profits or reputational damage; misuse of any data downloaded from the site; claim by any party in respect of any infringement or alleged infringement of its Intellectual Property Rights, arising out of or as a consequence of your use of the Annual Reporting Tool, or any breach of these Terms and Conditions, or any negligence, wilful act or omission or any wrongful or unlawful act or omission on the part of APCO, its personnel or authorised agents and contractors.
Limitations of liability
APCO and its authorised representatives will not be liable to you (whether under the law of contract, the law of torts or otherwise) in relation to any downloadable data, the contents of, or use of, or otherwise in connection with, this website:
- for any direct loss;
- for any indirect, special or consequential loss; or
- for any business losses, loss of revenue, income, profits, loss of contracts, loss of reputation or goodwill, or loss or corruption of information or data.
By using the Annual Reporting Tool, you accept the above Terms and Conditions and confirm that you have the authority to act on behalf of the organisation and give consent on its behalf to APCO, their agents, contractors or assigns to use the information you provide in your responses to the Annual Reporting Tool as outlined in these Terms and Conditions.
